DIVINE TERMS OF SERVICE

1. Introduction

Its Gutta Go LLC and its members, officers, directors, owners, employees, agents, representatives, suppliers, and service providers (collectively "Divine," "we," "us," or "our") provide this website (the "Site," which also includes any email newsletter owned by Divine) and Discord server (the "Discord," which also includes any online community owned in whole or in part by Divine) for informational purposes only. Use of and access to the Site and/or Discord and the information, materials, services, and other content available on or through them ("Content") are subject to these Terms of Service and all applicable laws. By accessing or using our services, you agree to these terms.

2. No Investment Advice

The Content is for informational purposes only and should not be construed as legal, tax, investment, financial, or other professional advice. Divine does not offer financial services, and no information on our Site or Discord constitutes a solicitation, recommendation, or endorsement to buy or sell any asset, securities, or financial instrument. Divine is not a fiduciary, and users assume full responsibility for evaluating the risks before making financial decisions.

Furthermore, no user-generated content - whether by customers or staff members of Divine - constitutes investment advice, and Divine disclaims any responsibility for financial actions taken based on such content.

3. Use of Service at Your Own Risk

Users acknowledge that Divine does not guarantee success, profitability, or continued access to third-party platforms such as Amazon, eBay, Discord, or any other services. Users assume full responsibility for any financial losses, account suspensions, terminations, or legal consequences resulting from their activities. Divine is not responsible for any enforcement actions taken by these platforms, including but not limited to policy violations, chargebacks, or disputes arising from third-party services.

Automated checkout tools and software may result in unintended orders, charges, or account actions. Users assume full responsibility for all automation-related outcomes.

4. Third-Party Links & Services

Divine may provide links to third-party websites for convenience, but we do not control or endorse these websites. Users acknowledge that any transactions, information, or content obtained from third-party sites are at their own risk. Divine disclaims any liability for damages arising from third-party websites or services.

Links posted on the Divine Site, and/or Discord may contain affiliate links from which Divine may earn a commission.

5. User-Generated Content (Discord & Community Disclaimer)

Divine is not responsible for user-generated content, including messages, opinions, or recommendations shared in Discord or community forums. Users acknowledge that information shared by other members does not represent Divine’s views and is not verified by us. Users are solely responsible for their contributions and any consequences arising from reliance on such information. Divine reserves the right to remove content that violates our policies but assumes no liability for harm caused by such content.

6. No Refunds & Chargeback Policy

All payments made to Divine are final and non-refundable. By purchasing any subscription, membership, or service, users acknowledge that Divine does not issue refunds for unused time, dissatisfaction, or failure to cancel before renewal. Chargebacks or payment disputes will be contested to the fullest extent, and users who initiate chargebacks may have their accounts permanently terminated. It is the user's responsibility to manage their subscription through their Whop account.

7. Business Transaction Disclaimer (Wholesale & Marketplace Transactions)

Divine does not act as a party to any transactions facilitated between members, wholesalers, suppliers, or third-party businesses. Users acknowledge that all transactions are conducted at their own risk, and Divine bears no responsibility for disputes, non-delivery, misrepresentation, fraud, pricing errors, chargebacks, or losses arising from such transactions. Divine does not vet, endorse, or guarantee any third-party seller, product, or service. Users should conduct their own due diligence before engaging in any transaction.

8. Auto-Renewal & Subscription Terms

All Divine memberships and subscriptions renew automatically at the end of each billing cycle unless canceled before renewal. Users are responsible for managing their subscriptions and must cancel through their Whop account before the renewal date to avoid further charges. No refunds, credits, or prorated reimbursements will be issued for canceled subscriptions or unused time. By subscribing, users authorize Divine to charge the provided payment method for recurring fees.

9. Risk Disclosure

Reselling, retail arbitrage, investment and other activities mentioned in Divine involve financial risk, including but not limited to account suspensions, product shortages, supplier fraud, pricing fluctuations, and market instability. Users acknowledge that participation in these activities is at their own risk and that Divine makes no guarantees of profit, earnings, or continued access to third-party platforms. Divine is not responsible for financial losses, supply chain disruptions, or changes in marketplace policies that may impact users’ ability to conduct business.

10. Limited Right of Use / Ownership of Content

Users may only use Divine’s Site, Discord, and Content for personal, non-commercial purposes. Divine retains all intellectual property rights to its content. Unauthorized reproduction, modification, or redistribution is prohibited without express written consent.

11. Indemnification

Users agree to indemnify, defend, and hold harmless Divine, its officers, directors, owners, partners, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from the use of Divine’s services.

12. Jurisdiction & Legal Compliance

Divine operates under U.S. law and makes no representations that its services, content, or materials are appropriate outside of the United States. Users are responsible for complying with all applicable local laws when using Divine’s services. Divine reserves the right to restrict access where its services are prohibited.

13. Arbitration & Class Action Waiver

All disputes shall be resolved through binding arbitration under the Federal Arbitration Act. Users waive their right to participate in class action lawsuits. All legal claims must be initiated within three (3) months of the alleged incident, or they will be permanently barred.

14. Modifications & Updates

Divine reserves the right to modify these Terms at any time by posting an updated version on the Site. Continued use of the services after changes constitutes acceptance of the revised Terms.

Cancellation, Refund & Chargeback Policy

1. General Terms

By accessing and using Divine's website, services, and community, you agree to this Cancellation & Refund Policy, which is designed to provide clarity on subscription cancellations, refunds, and chargeback disputes.

This policy applies to all paid memberships and subscriptions associated with Divine, including but not limited to those processed through Whop or any other third-party platforms.

2. Email Subscribers

Members subscribed to our free email lists can opt out at any time by clicking the "unsubscribe" link in the footer of any Divine email.

Important Note: Unsubscribing from one email list does not guarantee removal from all communications. Members may continue receiving transactional emails and may still be subscribed to other Divine-affiliated newsletters or services.

3. Paid Membership Cancellations

a. How to Cancel Your Subscription

Divine members may cancel their paid subscription at any time by following the appropriate process based on the platform they subscribed through.

If you experience issues canceling, please contact Whop Customer Support or open a Support Ticket in the Divine Discord for assistance.

b. What Happens After Cancellation?

Your access to premium content and features may be revoked immediately upon cancellation or you will retain access until the end of your billing cycle dang o.
Your membership will not renew, and you will not be charged for the next billing cycle.
Your account will be downgraded to a free membership, which may still include access to limited community features and email updates.

4. Refund & Chargeback Policy

a. No Refunds

All payments are final and non-refundable.

By purchasing a Divine subscription, you acknowledge that refunds will not be issued for any reason, including but not limited to:

Early cancellation before the end of a billing cycle.
Unused time remaining in a subscription period.
Dissatisfaction with the service or content provided.

Refund requests will not be honored, except in cases where required by applicable law.

b. Chargeback Disputes

Any chargeback initiated against Divine will be contested to the fullest extent. By subscribing to Divine, you agree to waive your right to initiate chargebacks for any membership fees.

If a chargeback is attempted:

Your account may be permanently banned from Divine services.
You will be prohibited from rejoining under any new account.
We reserve the right to pursue legal action or collection efforts if fraudulent chargebacks are filed.

Divine End User License Agreement (EULA)

1. Agreement Overview

This End User License Agreement (the “Agreement”) is a legally binding contract between you (“User” or “you”) and It’s Gutta Go LLC (collectively “Divine,” "we," "us," or "our"). This Agreement governs your use of Divine and its assets and functions, including all related documentation, the online community, and associated features.

By creating an account, downloading, installing, or using Divine, you expressly agree to this Agreement, our Terms of Service, Privacy Policy, and Cancellation Policy. If you do not agree, you must immediately discontinue use and delete all copies of Divine.

2. Changes to This Agreement

Divine reserves the right to update or modify this Agreement at any time. Any changes will become effective immediately upon posting. Users will be notified of material changes via email or a notice upon login. Continued use of Divine after such notice constitutes acceptance of the revised terms.

3. License Grant and Restrictions

a. License Grant:

Subject to the terms of this Agreement, Divine grants you a limited, non-exclusive, revocable, non-transferable license to download, install, and use Divine for personal, non-commercial use on devices owned or controlled by you.

b. License Restrictions:

You shall not:

Copy, reproduce, or distribute Divine in any form.
Modify, translate, adapt, or create derivative works of Divine.
Reverse engineer, disassemble, decompile, decode, or otherwise attempt to derive or access the source code or internal operations of Divine.
Remove, delete, alter, or obscure any trademarks, copyright, patent, or other intellectual property rights notices from Divine.
Sell, sublicense, distribute, lease, or otherwise commercially exploit Divine.
Use Divine in a manner that violates any applicable law, regulation, or third-party terms (e.g., Amazon, eBay, Discord policies).
Circumvent or attempt to bypass any security measures or access restrictions.

4. Limitation of Liability

To the maximum extent permitted by law, Divine is provided on an “AS-IS” basis without warranties of any kind. In no event shall Divine or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities arising from the use or inability to use Divine, even if advised of the possibility of such damages. Users assume all risks associated with the software.

5. Third-Party Platform Disclaimer

Divine is not affiliated with or endorsed by any third-party platform, including but not limited to Amazon, eBay, or Discord. Users are solely responsible for ensuring compliance with all applicable platform policies. Divine is not liable for any account suspensions, terminations, enforcement actions, or financial losses incurred as a result of using Divine.

6. Termination

Divine reserves the right to suspend or terminate your license to use the software at any time, for any reason, including but not limited to violations of this Agreement. Upon termination, you must immediately cease all use and delete all copies of Divine.

7. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
